LIFETIME STRUCTURAL WARRANTY

Leading Edge Pools does hereby warrant its One Piece Composite Pool only upon this express limited warranty to the original purchased
only on the following items:

Lifetime Structural Warranty
Leading Edge Pools warrants the structural soundness of its One Piece Composite Pool shell against water loss due to defects in workmanship
and materials for its lifetime of the original purchaser and or the first subsequent purchaser.

25 Year Pro-Rated Surface Warranty
Leading Edge Pools warrants the inside of its One Piece Composite Pools (against manufacturers defects) for a period of 25 years of which the first 3 years are non-pro-rated by Leading Edge Pools for workmanship defects, after the Third Year surface will be pro-rated by Leading Edge Pools. Pro-rated items are as follows: Year 4-25 owner is responsible for 8% of repair costs per year. For example Year 8=8%*5 years= 40% repair costs due by owner. Maximum 75% owner cost repair. Material, labor and travel expense are considered repair costs. Leading Edge Pools, upon warranty claim after year 3, shall give a written estimate of damages and may require a deposit before warranty work isperformed. Leading Edge Pools does not warranty against chemical damage to surface, bleaching due to excessive chlorine levels, or low PH levels. Customer must have water tested by an authorized testing facility no less than one time a month. Recommended chemical levels as follows: PH 7.2-7.8, Chlorine 0.5-3.0 range. Stress cracks are not considered surface defects and are not warranted unless pool leaks due to such problem. Also, fading above water line is not warranted due to excessive UV exposure. Any warranty claim must be made in writing within 7 days of warrant issue. Owner is responsible to drain and brace pool and fill pool with water after repair is finished at their expense.

One-Time Transferable Warranty
Leading Edge Pools allows a one-tome transfer of warranty from original purchaser to buyer for the first 10 years from date of purchase. Leading Edge Pools requires pool to be inspected and the new owner to be trained on pool operation by a qualified Leading edge Pools Dealer or service professional at owners’’ expense. No transfer of warranty available after Year 10. Transfer must be completed within 90 days of date of closing. Charges apply.

Items Not Covered and Exclusions to Structural and Surface Warranty
Warranty may also be void for the following:
Pool is drained for any reason more than 1” below skimmer outlet without notifying Leading Edge Pools for assistance.
Pool is damaged by acts of nature such as lightening strike, hurricane or flood damage, hydrostatic pressure from ground water, inadequate drainage of surface water around the pool such as spouts, sprinklers, and earthquakes.
Pool is not installed by a qualified Leading Edge Pools installer or without Leading Edge Pools assistance.
Owner does not give written notice of warranty claim within 7 days of noticing potential damage to pool shell.
Owner does not allow leading Edge Pools to remedy the issue during normal business hours.\
Owner neglects to maintain chemical balance within Leading Edge Pools Tolerance.
Proper water level is not maintained within Leading Edge Pools operation limits.
Warranty does not cover any plumbing fittings, connections, piping or products not manufactured by Leading Edge Pools or
damage they cause to the shell from leaking or failure.
Warranty may be void if independent testing lad finds no problems with the fiberglass Laminates used to manufacture pool shell.

Warranty Claim
Leading edge Pools in its sole discretion will determine if the warranty claim is due to a defect in workmanship or materials or alternatively whether the warranty claim is as a result of the actions or non-action by the installer, customer, or some other cause. If Leading Edge Pools determines that the warranty claim is a result of defects in workmanship or materials, Leading Edge Pools reserve the right to repair or replace the pool. In the event that Leading Edge Pools chooses to replace the pool this limited warranty does not include removal or installation of replacement pool. In the event Leading Edge chooses to repair the pool, it will repair it so that it can retain water. Any warranty repairs may require modifications to the pools surface area, color variations may occur in repaired area.

Disclaimers
Leading Edge Pools shall in no event be liable for any personal injury, property damage, direct, indirect, special incidental or consequential damage or losses of any kind arising from the performance or supply of the One Piece Composite Pool. The liability of Leading Edge Pools shall not exceed the original amount paid for the One Piece Composite Pool.

 

Limitations
This limited guarantee takes place of all other warranties, express or implied warranties of merchantable quality and fitness for any particular purpose. All previous representations, understandings and warranties in respect of the One Piece Composite Pool are hereby superseded and replaced by this limited guarantee.
